Land
Location: Intersection of 6 & Q Rd will be the SW Corner
Legal
Description: The Southwest
Quarter (SW/4) of Section Twenty-Four (24), Township Eight (8) South, Range
Twenty (20) West of the 6th P.M. Rooks County, Kansas being 160 acres
more of less.
General
Description: This tract of land
has 23.23 acres of CRP, 38.37 acres of pasture with excellent fence and the
balance of 94.1 acres is cropland.
2009 Taxes Were - $446.90
Terms:
20% down day of sale with the balance
to be paid at closing.
Possession:
Buyer shall be given possession
of all the CRP immediate upon closing. Possession of the pasture shall be March
1, 2011. Possession of the cultivated acres will be March 1, 2011 unless there
is a fall seeded crop in which instance possession of said cultivated acres will
be immediately following the 2011 wheat harvest. Note: If the tenant does
plant wheat this fall it will be on 1/3rd - 2/3rd split
and the land owner will be required to pay 1/3rd fertilizer and
chemical operations concerning said crop.
Minerals:
Seller shall convey 100% of
the seller(s) mineral interest to the buyer
Growing
Crops: Buyer shall receive an
undivided one-third (1/3rd) of the 94.1 acres of growing wheat. Buyer
will be required to pay the land owners one-third for any chemical or
topdressing applications made from the date of the auction.
Title
Insurance: Title insurance
shall be used to prove clear & merchantable title with the Buyer & Seller
sharing equally the owner’s policy expense. The mortgage policy, if required,
will be the expense of the buyer.
Taxes & FSA &
CRP Pmts. The 2009 and prior
years taxes will be paid in full by the sellers. 2010 Taxes will be prorated to
date of closing. All subsequent years taxes will be the responsibility of the
buyer. Seller shall convey to buyer all land owners share of the FSA payments
that may be payable from the date of this sale and Sellers will convey to Buyer
100% of all 2010 and subsequent years CRP payments. CRP contract expires Sept.
30, 2012 and payment is $30.40 per acre for a total of $702.00 annual payment.
