TRACT 1 - Legal Description: That portion of the South Half of the Northwest Quarter (S/2NW/4) and Southwest Quarter of the Northeast Quarter (SW/4NE/4) lying North of US Highway 24 in Section Seven (7), Township Seven South (7s), Range Fifteen West of the 6th P.M., Osborne County, Kansas

General Description: This tract of land contains approx. 84 total acres. There is approximately 19 acres of irrigated land under the Webster Irrigation District with the balance being dryland cropland, creeks, wildlife habitat & farmstead. The farmstead consists of 3 bedroom block home constructed 1890 w/approx. 1,800 total sq. ft. and has central air & heat and highway frontage. There is a single car detached garage, barn, utility sheds, grain bins and has it’s own water well. Creek tree lines provide abundant protection from the wind and also provides excellent habitat for wildlife

TRACT 2 – Legal Description: That portion of the East Half of the Northeast Quarter (E/2NE/4) lying North of US Highway 24 in Section Seven (7), Township Seven South (7s), Range Fifteen West of the 6th P.M., Osborne County, Kansas

General Description: This tract of land contains approx. 57 total acres. There is approximately 52 acres of irrigated land under the Webster Irrigation District with the balance being grass & waste. This property also has a water right allowing 18.5 acre feet at a rate of 225 gpm. Capacity and functionality of the existing irrigation well is unknown.

FSA Info; Bases are approx. as follows; Tact 1; Wheat -22.9 acres W/26 bu. yield, Corn – 11.7 acres W/113 bu. yield, Grain Sorghum – 11.6 acres W/89 bu. yield, Soybean - .7 acres W/30 bu. yield. Tract 2; Wheat -23.3 acres W/26 bu. yield, Corn – 11.9 acres W/113 bu. yield, Grain Sorghum – 11.7 acres W/89 bu. yield, Soybean - .8 acres W/30 bu. yield.

Growing Crops: Buyer shall receive the landlords share of 2010 wheat crop being an undivided 1/3rd interest. All Cropland acres are planted to wheat.

Minerals: Seller to reserve ½ the minerals for a period of 10 years or for as long as it is produced.

Taxes: Seller to pay all the 2009 taxes. 2010 and all subsequent years taxes will be the responsibility of the Buyer. Approx Taxes are; Tract 1 - $1,251.83 Tract 2 - $2,396.32

Possession: Possession of the farmstead, creeks & waste will be immediate upon closing. Possession of all acres planted to wheat will be immediately following the 2010 wheat harvest.

Title Insurance: Title insurance shall be used to prove clear & merchantable title with the Buyer & Seller sharing equally the owner’s policy expense. The mortgage policy, if required will be the expense of the buyer.
